OFFICIAL RULES (“Rules”)

NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE DURING THE GIVEAWAY. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

 

1. Who Can Enter

 

mXrevival’s Dream It - Build It - Win It (“Giveaway”) is open only to those people who participate each day and who are 18 years of age on the date of entry. The Giveaway is only open to legal residents of the United States of America and Canada (excluding QC) and is void where prohibited by law. Employees or contractors of any of the individual giveaway prize sponsor’s their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited. 

 

1. You Agree to Rules

 

By participating, you agree to be bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of mXrevival, as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state, and local laws. 

 

1. Giveaway Duration

 

The Giveaway for (1) grand prize 2006 Suzuki RM250 begins on 5/28/2024 at 12:00:00 AM and, ends once all 350 available entry slots have been filled.  All micro-giveaway entries for additional MX products (anything that is NOT the grand prize) will begin when their corresponding YouTube video is published as “Public” and micro-giveaway entries must be received by 12:00:00 AM PST no later than the sixth day following a micro-giveaway's video launch.  Winners will be selected on the 6th day following the start of each separate micro-giveaway and will be posted on one or all of mXrevival’s social media platforms: www.mXrevival.com, mXrevival’s Facebook, mXrevival’s Instagram, mXrevival’s TikTok or YouTube Channel in each subsequent YouTube video. mXrevival will close each giveaway once completed. All entries will be eligible to receive one (1) grand prize: A customized 2006 Suzuki RM250 Two Stroke, in addition to any additional prize(s) won during the giveaway’s duration. All winners of alternate prize(s) during the giveaway’s duration will still be eligible to win the grand prize.

 

1. Your Entry

 

Your entry must fulfill all Giveaway requirements, as specified throughout these Rules, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules, steps, or specifications may be disqualified at the sole discretion of mXrevival. You may not enter by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of mXrevival. Mail-in Entry: To obtain an entry without making a purchase, potentially redeeming either: (1) grand prize 2006 RM250 Build OR alternate prize(s) throughout the giveaway’s set timeline: Legibly handprint your name, street address, city, state or province, zip or postal code, country, telephone number, complete email address on a standard 4” x 6” postcard, with no outer envelope, and mail to: “mXrevival Dream It Build It Win It” 1577 N. Linder Rd. #139 Kuna, Idaho 83634. (“Mail-in Entry”). Mail-in Entry requests for the grand prize (RM250 build) must be received prior to the last RM250 entry slot being sold, or before these slots become "out of stock" on our website. For alternate prize(s), mail-in entries must be received before each alternate prize(s) is launched, which will be indicated by each alternate prize(s) corresponding YouTube video posting time & date. All Mail-in Entries must be legibly handwritten (including addressing), mailed separately with no outer envelope and have sufficient postage. Promotion Parties assume no responsibility for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for failure or unavailability of electronic equipment, communications or Internet connections; or other errors, failures or malfunctions of any kind. You will receive one (1) entries per mail-in entry. Limit one (1) mail-in entry. By entering via online or mail-in, you consent to receive email announcements from Sponsor, in accordance with its Privacy Policy, available at, http://www.mXrevival.com. You may unsubscribe from these email announcements without affecting your chances of winning this Promotion. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned except as provided herein. Entries which are incomplete, incorrect, incomprehensible, not received, or do not otherwise comply with these Official Rules will be void and will not be entered into the Promotion's prize drawing. Entries made by any other manner not specifically allowed under these Official Rules will not be entered into the Promotion and may result in disqualification of the responsible entrant. You are not a winner until your prize claim is validated and you receive official written notification from the Sponsor or the Promotion Administrator. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be declared made by the person in whose name the entry was made.

 

1. Specific Conditions

 

Any incomplete or illegible entries will not be processed. The use of automatic, robotic, macro, and / or pre-programmed entries is strictly prohibited. Any attempt by any participant to obtain more than the stated number of entries by using multiple / different social media accounts, email addresses, identities, registrations and logins, or any other methods may void that participant’s entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. mXrevival is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entry applications, which will be disqualified. In the event of a dispute as to any entry application, the authorized account holder of the social media account and / or email address, if applicable, used to register will be deemed to be the Entrant. Except in the case of gift entries, all entries must be made in the name of the individual and no transfer of ownership of a ticket is permitted. No entries will be accepted from or on behalf of, corporations, trusts, partnerships, or other entities. 

 

1. Prize(s)

 

Winners will receive the prize(s) either via preferred email account, (if online transactional giveaway) through mail delivery carrier at the discretion of mXrevival, or by freight methods selected by mXrevival which are specific to the grand prize 2006 RM250 Build. Actual / appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by mXrevival. No cash or other prize substitution permitted except at mXrevival’s discretion. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, Customs laws/ fees specific to your country, and/or local taxes or shipping/ freight fees shall be the sole responsibility of the winner. No substitution of prize or transfer / assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for mXrevival to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

1. Odds

 

The odds of winning depend on the number of eligible entries received in the Giveaway.  Bonus entries are permitted for select Giveaways and must be completed by the end of the Giveaway date.

 

1. Selection of Winner

 

Winners of the Giveaway will be selected in a random drawing under the supervision of mXrevival. Winners will be notified via the contact information provided on the entry form and / or via email to the email address they entered the Giveaway with within five days following the winner selection. mXrevival shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail, or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited, and an alternate winner selected. The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT mXrevival’s SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. 

 

1. Rights Granted by You

 

By entering this contest you understand that mXrevival, anyone acting on behalf of mXrevival, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. 

 

1. Specific Terms of Giveaway

 

mXrevival reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such a case, mXrevival may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by mXrevival. mXrevival reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions. mXrevival has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Giveaway rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, mXrevival reserves the right to seek damages from any such person to the fullest extent permitted by law. By entering the Giveaway you agree to receive email newsletters periodically from mXrevival. 1. Limitation of Liability

 

By entering, you agree to release and hold harmless mXrevival and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Giveaway and / or his / her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries. 

 

1. Disputes

 

THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF IDAHO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Idaho having jurisdiction. Further, in any such dispute, under no circumstances will a participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorney fees, other than participants actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.
